Degree of Offense: Possession with Intent to Distribute or Sell Marijuana

The law in NJ imposes different Marijuana Distribution Penalties depending on the amount of marijuana allegedly being sold. N.J.S.A. 2C:35 makes it a Fourth Degree to sell or distribute one (1) ounce or less of marijuana. It is a Third Degree crime to distribute between one (1) ounce and five (5) pounds of marijuana. A Second Degree offense arises under N.J.S.A. 2C:35-5 where the weight of marijuana involved is between five (5) pounds and twenty-five (25) pounds. It is a First Degree Offense to possess with the intent to distribute twenty-five (25) pounds or more of marijuana. There are several elements which a prosecutor must establish in Proving a Distribution case including the weight of the marijuana for the degree of offense charged. In determining the grade of marijuana distribution, the state may aggregate (add up) the weight of each individual sale involved.

If you were arrested or indicted for selling marijuana, you unquestionably require representation by an experienced attorney.
